Novelu terms of use

These are the agreements between you and getdialog BV ("we") about using Novelu. How we handle your data is set out in the privacy statement. By tapping "Agree" on the welcome screen, you agree to both.

1. What Novelu does

• Novelu helps you remember what matters to the people around you. You tell it about them, and Novelu gets reminders, moments and things to follow up ready for you.
• To understand your notes, Novelu uses AI from OpenAI, through Microsoft Azure in the EU. That is a fixed part of Novelu: without AI, the app doesn't work as intended. That is why you can't use Novelu without agreeing.
• Before a note leaves your phone, your phone replaces the names of people with codes. How that works, and when a name does not become a code, is set out in the privacy statement.

2. AI makes mistakes

• The AI reads your note and makes suggestions. That usually goes well, but not always. A date may be wrong, or something may end up with the wrong person.
• That is why Novelu only saves a suggestion after you have checked it. Whatever isn't right, you leave out. With "Something not right?" you can let us know.
• Don't use Novelu as your only source for something that really mustn't go wrong, such as medical appointments or payments.

3. Your account

• An account is for one person. You use an email address that is yours, and you keep your password to yourself.
• You are responsible for what happens with your account. If you think someone else can get into it, change your password and let us know.
• You can always delete your account in Settings. What then happens to your data is set out in the privacy statement.

4. Your backup and your recovery key

• Your backup is encrypted with your recovery key. Only you have it.
• If you lose your recovery key, we can't open the backup for you. So keep it safe.

5. Free and Pro

• Free: unlimited people, reminders and follow-ups, the encrypted backup, and a monthly AI allowance (currently 25 notes). If your allowance runs out, Novelu keeps your notes and the AI reads them as soon as the allowance is topped up again, at the start of the next month.
• Pro: plenty of AI for every day, within reasonable use (fair use), and sync between your devices. For €4.99 a month or €39.99 a year, with a 14-day free trial. If you have had the trial before, you won't get it again. The price in your store, in your own currency, is what applies.
• Reasonable use: Pro is meant for personal use. If you use the AI far more than that, the allowance for that month may run out.
• A subscription applies to your account, on all your devices, even if you bought it in the other store.
• Without Pro, or if Pro ends, all your data stays on your devices. Sync between devices then stops; with one device, your backup continues for free.
• Renewal and cancellation: a subscription renews automatically until you cancel it. You cancel in the App Store or Google Play, no later than 24 hours before the end of the period.
• Right of withdrawal: you buy Pro through the App Store or Google Play; withdrawal and refunds are handled through that store, under its terms. You can cancel the free trial at no cost while it is running.
• Apple: for the apps from the App Store, Apple's standard EULA (Licensed Application End User License Agreement) also applies.

6. What you do and don't do

• You use Novelu for yourself and the people around you, not professionally for others.
• You only tell what you yourself are allowed to know and keep. What you tell about others is your responsibility. Don't tell anything you wouldn't want them to tell about you.
• You don't try to use the AI or our server for anything other than Novelu. You don't get around limits and don't try to get at other people's data.
• You don't copy, sell or modify the app, except where the law allows it.

If you don't stick to this, we may restrict or terminate your account. Where possible, we'll let you know first.

7. Availability

• We do our best to make Novelu work well, but can't promise that it will always work without interruption.
• What you have on your phone stays usable without a connection too. Without a connection, notes wait until the AI can read them.
• We may change or improve Novelu. If we stop Novelu, we will let you know at least 3 months in advance, so that you can export your data.

8. Liability

• We are liable for damage you suffer because we don't keep our agreements, to the extent the law provides.
• Our liability is limited to the amount you paid for Novelu in the 12 months before the damage, with a minimum of € 50. This does not apply in the case of intent or gross negligence. Nothing in these terms limits your rights as a consumer.

9. Changes

• If we change these terms materially, the app will ask you to agree again.
• If you don't agree, you can no longer use Novelu and can delete your account. You can export your data first.
• Minor clarifications only get a new date.

10. Law and disputes

• These terms are governed by Dutch law.
• If you live in another EU country, you keep the protection that the law of that country gives you as a consumer.
• If you have a complaint, email support@novelu.eu first. We respond within 5 working days.
• If we can't work it out together, you can go to the competent court.
